Gloucester set to sue Sale over van Rensburg transfer – reports

Gloucester are looking to sue Sale Sharks for damages after they signed up the centre following his signature for Gloucester for the 2018-19 season.

The case was brought to light in a RFU disciplinary hearing earlier this year, which ruled that van Rensburg would pay a fine of £32,500, with a two-week ban and Sale were hit with a £20,000 fine and a five-point deduction, suspended for two years.

Reports suggest that Gloucester have looked to seek legal action after the 25-year-old joined the Sharks on loan instead of honouring his three-year deal, which he had only just penned with the Cherry and Whites.

The Cherry and Whites are looking for around £400,000 in compensation.

The mix up

Well, in the complicated scenario of contract signatures let’s examine the finer details.

Rohan Janse van Rensburg signed on 10 October 2017 a contract to play at Gloucester from 1 November 2018 for the next three seasons and he was paid an advance of £25,000 under the contract. He then signed a contract on 11 January 2018 to play for Sale Sharks from 1 July for the next three seasons.

Agent Matthew Ginvert also received a reprimand, a fine of £3,750 and was directed to undertake the agent’s education programme.

Witnesses at the hearing, called by the RFU, were: David Humphreys (ex Director of Rugby, Gloucester), Johan Ackermann (ex Head Coach, Gloucester), Stephen Vaughan (former CEO of Gloucester and now CEO of Wasps), and Martin St Quinton (Chairman of Gloucester).
